Acceptable Use Policy

This Acceptable Use Policy (hereinafter referred to as the "Policy") outlines what is appropriate and what is inappropriate when it comes to using ADA products and services. This Policy applies to any individual or entity that interacts with any ADA product or services.
The purpose of this Policy is to establish acceptable practices regarding the use of ADA resources in order to protect the confidentiality, integrity, security, responsibility, activity, IP rights, and security of information created, collected, and maintained.
In the interest of fostering a welcoming environment, we, as a company, are committed to making participation in our platform a harassment-free experience for everyone, regardless of age, body size, disability, ethnicity, gender identity and expression, level of experience, nationality, personal appearance, race, religion, or sexual identity and orientation.

ACCEPTABLE USE
I understand that I must use ADA systems in a responsible way, to ensure that there is no risk to my safety or to the safety and security of the systems, devices and other users. This agreement will also apply to any personal devices that may connect with ADA services.
USE OF THE SERVICE
This Policy governs use of the services no matter how accessed, including without limitation via a mobile, tablet or web.
You will ensure that your use of the Services is at all times compliant with this Policy and all applicable local, state, federal and international laws, regulations and conventions, including, without limitation, those related to data privacy or personal data. You represent and warrant to ADA that you will not infringe or violate the intellectual property, publicity, privacy or other rights of any third party. You also agree that you will not misuse the services. Misuse includes, but is not limited to:
Using the services to disseminate or convey inappropriate, defamatory, obscene, salacious, or unlawful information, images, or materials; or to defame, harass, stalk, threaten, or otherwise violate the legal rights of others;
Subscription fraud or unauthorized access;
Upload, post, transmit, share, or otherwise make available any of your data that is unlawful or illegal, including without limitation data that is libelous, invasive of another's privacy, obscene, vulgar, pornographic or indecent, or that contains, promotes or encourages acts of violence, terrorist activity or child exploitation;
Violate or encourage the violation of the legal rights of others (for example, this may include allowing end users to infringe or misappropriate the intellectual property rights of others in violation of the Digital Millennium Copyright Act);
Use the ADA platform to harm minors in any way;
Impersonate any person or entity, including, but not limited to, ADA personnel or representatives, or any other user, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Advocate bigotry, hatred or harassment of any person or group, including, but not limited to, ADA personnel or representatives;
Carry out any unlawful, immoral, invasive, infringing, defamatory or fraudulent purpose (for example, this may include phishing, creating a pyramid scheme or mirroring a website);
Intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;
Disable, interfere with or circumvent any aspect of the ADA platform or any security or authentication measures;
Probe, scan, or test the vulnerability of any system or network, unless done in accordance with ADA's written consent;
Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by ADA or any other third party (including an end user) to protect the ADA platform;
Generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisements or other solicitations ("spam");
Access, search, or create accounts for the ADA platform by any means other than our publicly supported interfaces (for example, "scraping" or creating accounts in bulk);
Attempt to access or search the ADA platform, shared materials or training courses or download such materials from the service using any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by ADA, through integrated Third-Party Products or other generally available third party web browsers;
Manipulate identifiers in order to disguise the origin of any of your data;
Upload, post, transmit, share or otherwise make available any of your data that you do not have a right to make available under any law or under contractual or fiduciary relationships;
Upload, post, transmit, share or otherwise make available any of your data in a manner that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
Sublicense, resell, rent, lease, transfer or assign the ADA platform or its use, or offer the ADA platform on a time share basis to any third party, unless expressly permitted in writing by ADA;
Access the ADA platform to build a similar or competitive product or service or copy any ideas, features, functions or graphics of the ADA platform;
Interfere with or disrupt the ADA platform, servers or networks connected to the ADA platform, or the equipment used to provide the ADA platform, or disobey any requirements, procedures, policies or regulations of networks connected to the ADA platform, including, but not limited to, using any device or software (for example, by overloading or flooding any part of the ADA platform);
Modify, adapt, or hack the ADA platform, or otherwise attempt to gain unauthorized access to the ADA platform or its related systems or networks;
Intentionally or unintentionally violate any applicable local, state, national or international law where you or your End Users use the ADA platform;
Use the ADA platform to engage in, promote or encourage any unlawful or illegal activities; and/or
Collect or store personal data about other users in connection with any of the prohibited conduct and activities set forth above.
Please note that only the English version of this agreement is enforceable. Any other language provided, including German, is provided for convenience purposes and is intended to be a direct translation.

Using the Services to disseminate or transmit inappropriate, defamatory, obscene, lewd or unlawful information, images or materials, or to defame, harass, stalk, threaten or otherwise violate the rights of others;
Subscription fraud or unauthorized access;
Upload, post, transmit, share or otherwise make available any data that is unlawful or illegal, including, without limitation, data that is defamatory, invasive of another's privacy, obscene, vulgar, pornographic or indecent, or that contains, promotes or encourages acts of violence, terrorist activity or child exploitation;
Infringing or encouraging infringement of the legal rights of others (e.g., this may mean allowing end users to infringe or misappropriate the intellectual property rights of others, in violation of the Digital Millennium Copyright Act);
Use of the ADA platform to harm minors in any way;
Impersonating any person or entity, including but not limited to ADA employees or agents, or any other user, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
Advocating bigotry, hatred, or harassment of any person or group, including, but not limited to, ADA employees or representatives;
Pursuing unlawful, immoral, invasive, infringing, defamatory, or fraudulent purposes (e.g., phishing, creating a pyramid scheme, or duplicating a website);
Intentionally spreading viruses, worms, Trojans, corrupted files, false reports, or anything else of a destructive or fraudulent nature;
Disabling, compromising, or circumventing any aspect of the ADA platform or security or authentication measures;
Investigating, scanning, or testing the vulnerability of any system or network, except in accordance with ADA's written consent;
Circumventing, avoiding, removing, disabling, compromising, decrypting technological measures put in place by ADA or any other third party (including an End User) to protect the ADA Platform;
Generate, distribute, publish or facilitate unsolicited bulk email, promotions, advertisements or other solicitations ("Spam");
Access, search, or create accounts for the ADA Platform by means other than our publicly supported interfaces (e.g., "scraping" or bulk account creation);
Attempt to access or browse the ADA Platform, Shared Materials or Courses, or download such materials from the Service, using any non-ADA machine, software, tool, agent, device, or mechanism (including spiders, bots, crawlers, data mining tools, or the like) through integrated third-party products or other commonly available third-party web browsers;
Manipulation of identifiers to disguise the origin of your data;
Upload, post, transmit, share or otherwise make available any data that you are not authorized to make available by law, contract or fiduciary relationship;
Upload, post, transmit, share or otherwise make available your information in a manner that infringes any patent, trademark, trade secret, copyright or other proprietary right of any other party;
reselling, renting, leasing, transferring or assigning the ADA Platform or its use or offering the ADA Platform on a time basis to third parties, unless ADA has expressly permitted this in writing;
Accessing the ADA Platform to develop a similar or competing product or service or to copy ideas, features, functions or graphics of the ADA Platform;
Disruption or malfunction of the ADA Platform, servers or networks connected to the ADA Platform, or devices used to provide the ADA Platform, or disregard of requirements, procedures, policies or regulations of networks connected to the ADA Platform, including, but not limited to, the use of devices or software (e.g., by overloading or flooding any part of the ADA Platform);
Tamper, customize, or hack the ADA Platform or otherwise attempt to gain unauthorized access to the ADA Platform or its related systems or networks;
Intentionally or unintentionally violate any applicable local, state, national or international law when you or your End Users use the ADA Platform;
Use the ADA Platform to engage in, promote, or support any unlawful or illegal activity; and/or
Collecting or storing personal information about other users in connection with any of the prohibited conduct and activities listed above.
